General Terms and Conditions
Enerdynamics’ online content is developed as both Courses and Learning Paths. A Course contains a single module and is focused on a specific industry topic. A Learning Path contains a bundle of modules that, when viewed together, focus on a broader topic of interest. Each Course ends with a Quiz that covers the curriculum addressed in that Course. To pass the Quiz you must score 70% or better. If you do not pass the Quiz, you may make additional attempts to do so. Once you pass the Quiz you will be offered the opportunity to download a certificate of completion for the Course. Most modules within a Learning Path also end with a Quiz and requirements for passing are the same as for Courses. Some shorter introductory and concluding modules do not contain a quiz, and to pass these modules you need to view all of the course screens. Once you pass all modules within a Learning Path you will be offered the opportunity to download a certificate of completion for the Learning Path.
When you purchase a Course or Learning Path, you are purchasing a non-exclusive license to use it consistent with the purchased license type for the license period you chose at the time of purchase. The license period begins at the time of purchase and during that time you may view the Course or Learning Path as many times as you like.
Ownership of all intellectual property rights, including all copyright, trademarks, designs and patents whether registered or unregistered, and all other intellectual property, software and goodwill relating to the course will remain with Enerdynamics. All course registrations are sold for single person usage only and are not to be broadcast or otherwise shared, unless specifically authorized by Enerdynamics.
You may not use a Course or Learning Path for any purpose other than for the purpose for which it has been provided and you agree not to use these products for illegal or inappropriate purposes. In particular, you agree that you will not use the courses to do any of the following: a) convey any false, unlawful, harassing, defamatory, abusive, hateful, racial, threatening, harmful, vulgar, obscene, seditious or otherwise objectionable or offensive material of any kind or nature; b) carry out any commercial business, send any unsolicited commercial emails, advertise or offer to sell any goods or services or conduct or forward surveys, contests, or chain letters; or c) falsify the origin or source of any content or other material. Your right to access and use our online Courses and Learning Paths may not be assigned, transferred, or sublicensed by you.
Enerdynamics retains the right to substitute substantially similar Courses for those initially selected as necessary and to update Courses periodically. Enerdynamics also reserves the right to remove Courses and Learning Paths from its curriculum at any time. In the event that a purchased Course or Learning Path is removed, Enerdynamics will issue a pro rata refund of the purchase price for such product. Enerdynamics generally reserves the right to cancel an order and refund your money for any reason, including the case where pricing was published in error.
U.S. Privacy Policy
Enerdynamics shares your concern about the protection of your personal information online.
The purpose of this privacy policy (the "Policy") is to help you understand what kinds of personally identifiable information we may gather about you when you visit our website located at www.enerdynamics.com and related subdomains (the "Site"), how we may use that information, whether we will disclose it, and how you can correct it. If in any instance we intend to use any information collected from visitors in a manner that would conflict with the terms of the Policy, we will provide additional notice that will govern any information so collected. As set forth below, this Policy describes only our U.S. information collection practices.
By using the Site, you signify your agreement with this Policy. If you do not agree to the terms of this Policy, you should not use the Site. We reserve the right to update or modify this Policy from time to time. Your continued use of the Site after any changes to the Policy will mean that you have accepted the changes.
The Personal Information We Collect. The Site includes both public areas, open to all visitors, and private areas that are open only to those who choose to register. In addition, users can sign up on the Site to request newsletters and other information from Enerdynamics.
We ask you to provide us with personally identifiable information when registering to use private areas of the Site. Such information may include, for example, your name and email address. We also collect the personal information that you provide voluntarily for other purposes, such as when you request Enerdynamics’ newsletter. If you contact us, by email or regular mail, we may keep a record of your correspondence.
Personally identifiable information that we collect does not include information pertaining solely to corporations or other business entities, such as, for example, a company's address, from which individuals cannot be identified. We may use any such corporate information without restriction. Enerdynamics may also collect and aggregate information about visits to the Site, including, for example, visitors' IP addresses. We also may use such information in its aggregated form without restriction.
We may use "cookies", which are small text files placed on a user's computer hard drive that act like an identification card for the user. Cookies are only read by the server that placed them, and are unable to execute any code or virus. Cookies allow Enerdynamics to serve you better and more efficiently, and to personalize your experience on the Site. You should be able to control how and whether cookies will be accepted by your web browser. For more information on how to do so, please refer to the documentation accompanying your browser.
This Site is not directed toward children (that is, minors younger than thirteen years of age). We do not knowingly collect personally identifiable information from children.
How We Use the Personal Information that We Collect. Enerdynamics uses personally identifiable information for the purpose for which you supplied it to us, in other ways for which you have given us permission, and as permitted by law. For example, if you provide your email address in connection with a request for information, we will use your email address to send the requested information to you.
Enerdynamics does not sell, lease, share, or otherwise disclose any of your personally identifiable information to third parties, unless you have given us permission to do so, or as described below. Enerdynamics reserves the right to send you information regarding Enerdynamics’ products and services from time to time. You you may opt out of these choices at any time by following the instructions that are included with such mailings, or by sending an email to info@enerdynamics.com. Any request made to this email address will become effective within seven (7) business days following its receipt.
Enerdynamics reserves the right to release information concerning any visitor when that visitor is in violation of any published guidelines for the use of the Site, or participates (or is suspected of participating) in any illegal or potentially illegal activity. Enerdynamics also reserves the right to disclose personally identifiable information to comply with applicable law, in response to civil subpoenas or discovery requests, to protect other visitors of the Site, or to respond to an emergency. Enerdynamics may disclose personally identifiable information to our contractors, consultants, or professional advisors, but only to the extent necessary for them to perform services on our behalf, and only under reasonable confidentiality restrictions. Finally, in the event that we sell or transfer assets related to the Site, we reserve the right to transfer any and all information associated with the Site to such third party.
Leaving the Site. Enerdynamics may provide links on the Site that will take you to third party websites. Please note that third parties may collect information about you, through cookies or other technologies, when you link to their websites. You acknowledge that we do not monitor, endorse or control the information collection or privacy practices of these or any other third parties. We strongly encourage you to review the privacy policies of such third parties to understand how they collect and use information.
Security. We use reasonable security methods to protect the data that resides on our servers. However, no security system is impenetrable. We cannot guarantee the security of our servers, nor that information that you supply will not be intercepted while being transmitted to us over the Internet.
Correcting/Updating Personal Information. If your personally identifiable information changes, you may correct or update it by logging into your account and changing your information there, or by emailing a request to revise your information to info@enerdynamnics.com. Keep in mind that there will be residual information within our databases, access logs and other records, which may contain the personally identifiable information that you first provided.
